California Guardianship Document Preparation Services
A California guardianship is a court proceeding in which an adult who is not the child’s parent asks the court for authority to care for a minor child, manage the child’s property, or both.
A guardianship of the person gives the appointed guardian responsibility for the child’s care, custody, education, medical needs, and general welfare. A guardianship of the estate may be necessary when a minor owns or receives significant money or property that requires court-supervised management.
Guardianship is different from a conservatorship. In California, conservatorships generally concern the care or finances of an adult who is unable to manage certain personal or financial matters.

Our California Guardianship Document Preparation Process
1. Initial Consultation
We begin with an initial consultation to obtain information regarding the child, the proposed guardian, the parents, other relatives, and the circumstances creating the need for guardianship.
We also identify the documents that appear necessary based on the type of guardianship the client has chosen to pursue.
CA Law Docs does not provide legal advice or determine whether guardianship is legally appropriate for a particular situation. Clients who need legal advice regarding their rights, contested custody issues, or which legal procedure they should pursue should consult a licensed California attorney.
2. Guardianship Document Preparation
Once we receive the necessary information, we prepare the applicable California guardianship forms and supporting documents at the client’s direction.
Depending on the matter, the documents may include a Petition for Appointment of Guardian, confidential screening forms, declarations, notices, proposed orders, and other Judicial Council forms required by the court.
We carefully prepare the paperwork for filing and identify information that may still be needed before the documents are submitted.
3. Court Filing Assistance
After the documents are completed and reviewed by the client, we can assist with filing the guardianship petition and related documents with the appropriate California Superior Court.
The court will assign a hearing date and may require additional documents, notices, investigations, or local forms before the hearing.
4. Notice and Service Documents
California guardianship proceedings generally require notice to specified family members and other interested persons.
We prepare the applicable notice and proof-of-service documents and provide procedural instructions regarding service requirements.
When a person entitled to notice cannot be located, additional documentation regarding search efforts or a request to dispense with notice may be required.
5. Court Investigation and Hearing Preparation
After filing, the court may conduct an investigation regarding the proposed guardianship. The court will then hold a hearing to determine whether the requested guardianship should be granted.
CA Law Docs can prepare documents required for the hearing, proposed orders, and other paperwork requested by the court.
CA Law Docs is not a law firm and does not appear in court or represent clients at guardianship hearings.
6. Appointment and Letters of Guardianship
If the court grants the petition, the judge may sign an order appointing the guardian.
Additional documents may then be required before the court issues Letters of Guardianship, which provide evidence of the guardian’s court-appointed authority.
We can assist with preparing the documents necessary to complete the appointment process.
Temporary Guardianship Document Preparation
When there is an immediate need to protect or care for a minor before the general guardianship hearing, a request for temporary guardianship may also be filed.
Temporary guardianship requires additional forms and court procedures and is generally intended to address an immediate need pending the court’s determination of the general guardianship petition.
We can assist self-represented clients with preparing both temporary and general guardianship paperwork when requested.
Guardianship of the Estate
A guardianship of the estate involves responsibility for managing money or property belonging to a minor.
A guardian of the estate has ongoing fiduciary responsibilities and may be required to file inventories, accountings, and other documents with the court.
CA Law Docs can provide document preparation assistance for required guardianship-of-the-estate filings at the client’s direction.
Ongoing Guardianship Document Assistance
A guardian may have continuing court obligations after appointment.
Depending on the type of guardianship and the court’s orders, additional documents may be required during the guardianship or when circumstances change.
CA Law Docs can assist with the preparation of subsequent guardianship documents, including petitions, reports, accountings, requests for modification, and termination documents when applicable.
